App Terms of Service

We are TZ APAC Pte. Ltd. (UEN: 202012283D), a private limited company incorporated under the laws of Singapore with its registered address at 36 Robinson Road, #07/05-06 City House, Singapore 068877, as the operator of Kampawng (“we” or “us”).
Acceptance of the Kampawng Terms of Service
This document sets out the terms and conditions (the “Terms of Service”) that are effective as of the first date you (“you”) use Kampawng and its sub-domains, any pages and/or functionalities, and any of the APIs and other component applications to access the Service (as defined below) and/or use other functions.
Kampawng is a local-first pet health and care application that allows users to keep pet profiles and health records on their own device, import and read documents, set reminders and routines, share bounded access with household members and caregivers, pair NFC tags for care continuity, publish a Pet ID so that a finder can make contact, and take part in optional pilot features. Kampawng is a product of Keystone Lab and is operated by TZ APAC Pte. Ltd.
When you access and use the Service, you signify that you have read and understand, and agree with these Terms. If you do not agree to these Terms, you are not permitted to use the Service. These Terms have the same force and effect as an agreement in writing.
You must be at least 18 years old to use the Service. You must also have the legal capacity to enter into these Terms.
Your use of the Service is also subject to our App Privacy Policy (and our Website Privacy Policy for website interactions), which explains how we collect, use, store, and protect your information.
Definitions and Interpretation
In these Terms of Service, these words and phrases have the following meanings:
- “Service” means the Kampawng mobile application, guest-care web application, sharing service, tag pages, website, APIs, software, on-device recognition features, infrastructure, and related services we make available.
- “User” means any individual or entity that accesses or uses the Service, including a Recipient.
- “User Content” means any content you upload, submit, import, create, record, transmit, store, or generate through the Service, including pet profiles, health and care records, notes, routines, reminders, photos, videos, documents, attachments, backups, transfer files, and related metadata.
- “AI Outputs” means any recognised text, extracted field, suggestion, classification, or other output generated by the Service using on-device artificial intelligence, machine learning, optical character recognition, or related technologies.
- “Grant” means an authorisation you create permitting a named Recipient to view or contribute to specified information about a pet, for a scope and period you choose.
- “Recipient” means a household member, caregiver, boarding facility, or other person or entity you authorise through a Grant.
- “Pet ID” means a link or code you publish so that a person who finds your pet can read the information you selected and make contact.
- “Tag” means a physical NFC tag used with the Service.
- “Pilot Feature” means a feature we describe as a pilot, preview, beta, experimental, or early access, including the Singapore donor pilot.
- “Third-Party Individual Data” means personal data of an individual other than you that is contained within User Content, including the name or contact details of a veterinarian, clinic, breeder, shelter, previous owner, or co-carer referenced in a document, health record, or a published Pet ID.
- “Local Storage” means storage of data on your device, browser, operating system, local application cache, or other user-controlled environment, rather than on our servers.
- “Third-Party Services” means products, services, software, APIs, hosting, storage, payment processors, analytics tools, browser technologies, app marketplaces, notification services, and other systems provided by third parties that may interoperate with or support the Service.
License Grant & App Store Terms
Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on Apple-branded devices that you own or control, strictly in accordance with these Terms and the Apple Media Services Terms and Conditions.
Eligibility
You represent and warrant that you are at least the legal age required to form a binding contract under applicable law. If you enter into these Terms on behalf of an entity or other organization, you represent and warrant that you are duly authorized to bind such entity or organization to these Terms, in which case “you” and “your” refer to that entity or organization.
You further represent and warrant that neither you, nor any person or entity that owns, controls, or acts on your behalf (including any subsidiaries, affiliates, officers, directors, employees, agents, contractors, consultants, or ultimate beneficial owners), or other digital identifier used in connection with the Service, is the subject of, owned or controlled by a person or entity that is the subject of, or acting on behalf of a person or entity that is the subject of any sanctions, export control, or trade restriction laws and regulations applicable to TZ APAC or to you under the laws of Singapore or any other applicable jurisdiction — including without limitation those administered under the United Nations Act 2001 of Singapore and any regulations issued by the Monetary Authority of Singapore, or under any other applicable international sanctions regime, including without limitation sanctions administered by the U.S. Department of the Treasury’s Office of Foreign Assets Control (OFAC) (collectively, “Sanctions Laws”) — and that you are not located, organized, resident, or operating in any jurisdiction subject to comprehensive sanctions or targeted financial sanctions under such Sanctions Laws, except to the extent authorized by applicable law.
The Service contains cryptography, and you are responsible for complying with any export, import, or use restrictions applicable in your jurisdiction.
TZ APAC may immediately suspend, block, or terminate access to the Service where it reasonably suspects sanctions exposure, AML risk, fraud, regulatory non-compliance, or other legal risk, without liability. You agree to indemnify and hold harmless TZ APAC from and against any fines, penalties, enforcement actions, or regulatory liabilities arising from your breach of Sanctions Laws or other applicable laws.
Minor and Child Safety
You must not use the Service to record, share, or publish information about a minor without obtaining all required prior parental or guardian consent under applicable law, including naming a minor as a co-carer, owner, or emergency contact, or publishing a minor’s details through a Pet ID. You must not use the Service in any manner that knowingly results in the collection of personal data of a minor under the age of 18, or under such a higher age threshold as required by applicable law in your jurisdiction.
Use of Service
To use the Service, you will need to access it via the app, the guest-care web application, or our website. We make no guarantees, expressed or implied, regarding the accessibility, availability, or uninterrupted operation of the Service. Users acknowledge and agree that the Service and functionalities may become inaccessible, experience downtime, or cease operation at any time and for any reason, without prior notice.
Description of the Service
Kampawng helps you keep a private history of your animals’ care and hand a bounded part of it to the people who look after them. Functionalities and features include:
- Private pet profiles and health, medication, and care records held in encrypted form on your own device.
- Import of photos, scans, and documents, with on-device text recognition and suggested field values presented for your review before saving.
- Reminders, routines, and care scheduling.
- Household sharing through Grants, with roles, scopes, expiry, and revocation, where content is encrypted by your device for the Recipients you select.
- Guest care through our web application, allowing a caregiver you invite to record care notes and photos, including while offline.
- Tag pairing for care continuity, and public tag pages.
- Published Pet IDs.
- Notifications delivered through Apple’s Push Notification service.
- Backup, export, and ownership transfer, including passphrase-protected archives.
- Care recognition features derived on your own device, which are not a measure of an animal’s health or of the quality of care given.
- Optional anonymous usage statistics, which are off by default.
- Pilot Features, including the Singapore donor pilot.
Features may vary depending on the device, operating system, browser, household role, geographic region, third-party service availability, hardware such as NFC support, or technical constraints.
Device Identity and Security
No Account: Kampawng does not use an email-and-password account and does not offer third-party sign-in. Your records are held on your own device.
Device Identity: When you enable a sharing feature, your device registers a cryptographic identity with our sharing service. That identity, rather than a username and password, is how the Service recognises your device.
Device Security: You are responsible for maintaining the security of your device and for all activity carried out by any device holding your identity, except to the extent caused by our failure to use reasonable security measures. You must promptly notify us at [email protected] if you suspect unauthorised use of your device or identity.
No Identity Sharing: You may not share, export, or transfer your device identity or its key material, or allow an unauthorised person to access the Service through your device.
Household Administration: Certain household roles allow an owner or administrator to invite, manage, and remove members and devices and to revoke Grants. If you accept such a role you are responsible for exercising it appropriately.
Revocation: We may revoke a device identity where we reasonably believe it has been compromised or misused or presents a risk to other Users or to the Service.
Electronic Communications: By using the Service or providing your contact information, you consent to receive electronic communications from us, including service notices, security alerts, legal disclosures, and product updates, by email (where you have provided one), in-app notice, push notification, or similar means.
Consent and Information About Others
You are solely responsible for obtaining all notices, permissions, waivers, and consents required to record, import, share, or publish information about any person using the Service, including a co-carer, veterinarian, clinic, breeder, shelter, previous owner, emergency contact, or any person named in a document you import.
A published Pet ID may include another person’s name and contact details. Publishing those fields makes that information readable by anyone holding the link, and you must obtain that person’s agreement first and revoke the Pet ID if it is withdrawn.
If you share a pet profile with a veterinarian, sitter, boarding facility, family member, or other caretaker through a Grant, you are responsible for ensuring that such sharing is appropriate and, where relevant, for informing anyone whose data appears in the shared content (such as a co-carer or veterinarian named in a record) that their information is being shared through the Service.
We do not independently verify that a User creating a pet profile is the pet’s legal owner, and we are not responsible for disputes between Users, co-carers, or third parties regarding ownership of, or rights to, a pet profile or its content. Roles, Grants, Tags, and shortcuts within the Service describe access within the software; they do not establish ownership of an animal, custody, or authority to consent to veterinary treatment.
We do not provide legal advice regarding data protection, consent obligations, animal welfare, or veterinary regulation. Laws vary by jurisdiction and you should seek independent legal advice where necessary.
Veterinary & Medical Advice Disclaimer (Important)
KAMPAWNG IS NOT A VETERINARY CLINIC AND DOES NOT PROVIDE VETERINARY MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.
The Service is a record-keeping and coordination tool. It is not veterinary advice and is not a medical device. Nothing in the Service diagnoses, treats, prescribes, calculates a dose, or assesses whether an animal is healthy. Records, reminders, routines, dose schedules, extracted document fields, and any suggestion the Service produces are information you have chosen to record or review, and do not replace a qualified veterinarian’s judgement.
Always seek the advice of a qualified veterinarian about your animal’s health, medication, and treatment, and never delay or disregard that advice because of something recorded in or produced by the Service.
The Service is not an emergency service. Do not rely on reminders, notifications, a Pet ID, guest-care delivery, or a Pilot Feature to reach anyone in an emergency.
We do not verify, certify, or vouch for any record, document, microchip number, vaccination status, ownership claim, clinic, or identity in the Service.
You must not rely on the Service, including any record or AI Output if any, as the sole basis for a decision that could reasonably result in harm to a pet, including in an emergency, surgical, medication, or other time-sensitive veterinary decision.
Local-First Architecture & Backup Responsibility
Title to and control over all User Content remains with you or, where applicable, with the individuals whose personal data it contains. Use of the Service does not transfer ownership of User Content to TZ APAC or Kampawng, and we do not claim ownership over it.
Where User Content is stored on our servers it is, with the limited exceptions described in our Privacy Policy, encrypted by your device before it reaches us, and we access and process it solely for the purpose of providing the Service. Where User Content is stored locally on your device, we do not have access to that data. We do not use User Content to train artificial intelligence models or for marketing.
You acknowledge and agree that you are solely responsible for maintaining backups of your device and data. Because your records are held on your own device, we hold no copy to restore. The Service can create a backup protected by a passphrase you choose, and we cannot recover that passphrase or open the backup without it. Once you save or send a backup or transfer file, it is outside the Service and outside our control.
You are also solely responsible for:
- maintaining backup copies of your User Content;
- the accuracy and legality of all User Content, including ensuring you hold all necessary rights, licences, and permissions in any content you upload; and
- any decisions or actions you take in reliance on outputs generated by the Service.
Kampawng is not liable for loss, corruption, or unavailability of User Content arising from service interruptions, device loss or failure, deletion, reset, uninstallation, loss of a passphrase, termination, or other operational events, except to the extent caused by our gross negligence or wilful misconduct.
AI Features and Outputs
Nature of AI Features: The Service may use artificial intelligence, machine learning, optical character recognition, language models, and related technologies to generate AI Outputs from documents and text you import.
On-Device Processing: These features operate on your device using the operating system’s own frameworks. The Service does not transmit your documents or the text recognised from them to any third-party artificial intelligence provider. If this changes, we will update these Terms and our Privacy Policy and obtain any permission required by applicable law and app marketplace rules before the change takes effect.
No Guarantee of Accuracy: AI Outputs may be inaccurate, incomplete, misleading, out of date, unavailable, or inappropriate for your intended use. Extracted dates, dosages, vaccination names, microchip numbers, or other fields may be misread, mis-transcribed, or omitted, and you are responsible for reviewing and correcting any AI Output before relying on it.
Probabilistic Systems: AI systems are probabilistic and may produce variable results for the same or similar inputs. Availability may depend on your device and operating system version.
No Professional Advice: AI Outputs are provided for general informational and productivity purposes only and do not constitute veterinary, medical, legal, financial, tax, compliance, employment, or other professional advice.
User Responsibility: You are solely responsible for reviewing, verifying, and determining whether to rely on any AI Output and for any action you take based on the Service.
Shared Care & Guest Caregiver Handover
Grants and Revocation: A Grant names a Recipient, a scope, and a period, and you may let it expire or revoke it at any time. Revoking a Grant, removing a member, revoking a Pet ID, or deleting your relay account stops further access. It does not recall information a Recipient has already received, decrypted, viewed, copied, or exported.
Recipient Obligations: If you are a Recipient, you may use the information you receive only to carry out the care you agreed to, must not copy, publish, or retain it beyond the engagement, and must not attempt to reach information outside the scope granted to you. Care you record is preserved with attribution and may be reviewed by the pet’s owner.
Guest-Care Local Data: The guest-care web application stores its keys and any work pending submission in the caregiver’s own browser. Deleting data in the owner’s app does not clear a caregiver’s browser.
Published Pet IDs: A Pet ID is public by design. Anyone holding the link or scanning the code can read the information you selected, without signing in, for as long as it remains active, and we can read it as well. You may revoke it or let it expire; access then ends for new readers but not for anyone who has already read or saved it.
Tags: A Tag is a physical object and we cannot erase, disable, or reprogram a Tag remotely. Deleting data in the app or revoking access does not change what is written on a Tag you hold. Tags are physical stickers subject to loss, damage, demagnetisation, or malfunction, and we are not responsible for logging gaps or inaccuracies resulting from a lost, damaged, unreadable, or incompatible Tag, or from device or operating-system NFC limitations. Where a Tag is lost, stolen, permanently read-only, or cannot be verified, the remedy is replacement or re-provisioning rather than remote recovery. Where scanning is unavailable or impractical, you may log activity manually; the accuracy of that record depends on timely and accurate entry. The Service may support offline logging, with entries stored locally until connectivity is restored and encrypted in transit during sync; records reflect only what has been entered or scanned and may not reflect a pet’s complete activity history. A Tag may be readable by any NFC-capable device, and we make no guarantee about the durability, readability, or compatibility of third-party Tags or of any Tag subjected to damage or wear. Provisioning tools for first-party Tags are made available only to operators we authorise, and you must not use, share, or circumvent them without that authorisation.
Pilot Features: Pilot Features are offered as-is and may be changed, suspended, or removed at any time without notice or replacement. The Singapore donor pilot is subject to its own separate consent. Kampawng does not assess suitability, screen animals, verify blood types, arrange transport, or supervise donation; a qualified veterinary team decides all clinical matters, and you confirm that a veterinarian has requested a donor before publishing a request. Matching is best-effort and we do not guarantee a match, a response, or an outcome. Contact details are exchanged only where both participants explicitly agree, and cannot be recalled once received. Any arrangement, cost, transport, or treatment between participants is between them, and we are not a party to it. We may pause or remove a participant’s access, act on abuse reports, and access pilot information for those purposes.
Data Storage and Security
We take the security of user data seriously and use reasonable technical, organizational, and administrative safeguards designed to protect data processed through the Service.
- Encryption and Secure Transmission: We use encryption to help protect data during storage and transmission. Content shared through a Grant, care records, guest-care media, and Tag bindings are encrypted by the sending device before they reach us.
- Local Storage and On-Device Security: Most User Content is stored locally on your device, and a caregiver’s pending work is stored in their own browser. You are responsible for securing your device and local environment. If your device is lost, stolen, shared, rooted, jailbroken, infected with malware, or otherwise compromised, locally-stored data may be exposed, lost, altered, or corrupted. An optional recovery key may be held in your Apple iCloud Keychain where you enable recovery, in which case its availability depends on your Apple account and Apple’s service.
- Offline Use and Sync: The Service supports offline recording of care, and data transmitted during sync is encrypted in transit.
- Server-Side Processing: Depending on the feature and configuration, data may be stored or processed on servers operated by us or by authorized service providers, and is encrypted at rest.
- No Third-Party AI Providers: The Service does not transmit User Content to any third-party artificial intelligence provider.
- Access Controls: We apply access controls designed to limit access to user data to authorised personnel, systems, and service providers who need such access for legitimate operational purposes.
- Data Retention: We retain data only for as long as necessary to provide the Service, fulfil the purposes described in our Privacy Policy, and comply with legal obligations.
- Cross-Border Data Transfers: Because the Service may involve cloud infrastructure, network providers, notification services, and other service providers, your data may be transferred to, stored in, or processed in countries outside Singapore. Where required, we use appropriate safeguards for international transfers.
Data Breach Response and Notification
If we become aware of a personal data breach, we will take reasonable steps to investigate, contain, remediate, and mitigate the effects of the breach. Where the breach is notifiable under Singapore’s PDPA, we will notify the Personal Data Protection Commission (PDPC) within 3 calendar days of making that determination. Where the GDPR applies, we will notify the relevant supervisory authority without undue delay and, where feasible, within 72 hours. We will notify affected individuals where legally required or where we determine notification is appropriate. Where a breach involves contact details published through a Pet ID or exchanged in a Pilot Feature, we will treat the incident as high-risk by default.
No Absolute Security Guarantee
No service, device, network, storage system, encryption method, or transmission method is completely secure. We do not guarantee that the Service will be immune from unauthorized access, security incidents, data loss, corruption, or other security risks. Encryption protects the content of what you share; it does not render unreadable to us the identifiers, dates, and routing information we need in order to deliver it.
Data Portability and User Rights
You have the right to request a copy of your personal data held by us in a structured, commonly used, and machine-readable format. To submit a data portability request, contact us at [email protected] with “Privacy Request” in the subject line. We will respond within 30 days. Additional rights including rights of access, correction, withdrawal of consent, and erasure are set out in our Privacy Policy. Because your records are held on your own device, a request about that content is usually satisfied fastest by the app’s own export and deletion controls.
Where you are located in a jurisdiction whose mandatory consumer protection or data protection laws confer rights that cannot be waived by contract, nothing in these Terms limits those rights.
Payment Terms
The Service is currently provided at no charge and contains no in-app purchase. If we introduce a paid subscription or feature, fees, pricing, billing cycles, and applicable charges will be as displayed at the time of purchase, may vary by plan, feature, usage pattern, or geographic region, and payment will be processed by the provider disclosed to you at that time. Nothing in these Terms obliges us to keep any feature free.
Acceptable Use & Intellectual Property
The Service and all related content, features, functionality, trademarks, logos, software, and intellectual property rights therein are owned by TZ APAC or its licensors and are protected by applicable intellectual property laws. Nothing in these Terms grants you any right, title, or interest in or to the Service or any intellectual property rights therein, except for the limited right to use the Service in accordance with these Terms. Open-source components, fonts, and third-party assets remain governed by their own licences, and in the event of a conflict between these Terms and an applicable open-source licence, the open-source licence controls with respect to the specific component concerned. Feedback you send us is voluntary and we may use it without obligation or compensation.
Use Restrictions
Unless otherwise agreed with TZ APAC in writing, you shall not, and shall not encourage or authorize others to:
- use the Service in any manner not expressly authorized by these Terms;
- copy, modify, reproduce, adapt, distribute, display, publish, license, sell, rent, lease, sublicense, transfer, reverse engineer, disassemble, decompile, or otherwise attempt to derive source code from the Service, except to the extent expressly permitted by applicable law or by the applicable open-source licence;
- use the Service for benchmarking, competitive analysis, monitoring availability or performance, or developing competing products or services;
- circumvent, disable, interfere with, or bypass any usage limits, quotas, security measures, or access controls, including any Grant, scope, expiry, revocation, household role, device identity, signature, or Tag credential;
- attempt to read, decrypt, or infer the content of another person’s encrypted data;
- use automated means to access, collect, cache, aggregate, or extract data from the Service, or to enumerate Tag identifiers, invitation codes, or Pet ID links;
- use the Service in a manner that exceeds reasonable request volumes or interferes with the stability of the Service;
- use the Service to engage in unlawful, fraudulent, deceptive, or abusive activity, including misuse of a Pilot Feature;
- use the Service in connection with any activity that violates applicable sanctions, export control, data protection, or consumer protection laws;
- use the Service to distribute malware, spyware, adware, or other malicious code, or to test vulnerabilities without TZ APAC’s prior written authorisation;
- use the Service in a manner that infringes or misappropriates intellectual property, privacy, or other rights of any third party, including any Third-Party Individual Data uploaded without appropriate rights;
- imply any endorsement, partnership, sponsorship, or affiliation with TZ APAC, Keystone Lab, the Service, or any related brands without prior written consent;
- conceal or misrepresent your identity, your authority over an animal, your relationship to another User, or a veterinary request; or
- use any data obtained through the Service for advertising, resale, or other commercial exploitation except as expressly permitted.
Legal Basis, Cookies and Tracking
For the purposes of applicable data protection laws, TZ APAC acts as an independent data controller with respect to personal data processed in connection with device identity, service operation, sharing authorisation, notifications, pilot features, security, compliance, and service improvement. Users are responsible for ensuring that they have a valid legal basis for any personal data, including Third-Party Individual Data, that they upload, process, or make available through the Service. For more details, see our Privacy Policy.
Cookies and Tracking Disclosures
- iOS App: Kampawng does not track your activity across other companies’ apps or websites for advertising purposes, does not use Apple’s advertising identifier, and does not share your data with advertising networks or data brokers. The app uses no browser cookies.
- Website: Our website uses a strictly necessary cookie to record your analytics choice and places analytics cookies only after you allow analytics. Cookie preferences remain available in the website footer.
- Guest-Care Web Application: Sets no cookies and stores its keys and pending work in the caregiver’s own browser storage.
Service Availability, Preview Features and Changes
We do not guarantee that the Service, or any feature of it, will always be available, uninterrupted, timely, secure, or error-free, and we do not guarantee that a reminder, notification, sync, Tag scan, guest-care submission, or pilot alert will occur or arrive on time. Features, interfaces, workflows, on-device model behaviour, and outputs may change over time, and we may update, replace, or remove features, settings, models, or integrations, which may affect the Service’s behaviour and outputs, including previously generated AI Outputs.
Some features may be designated as alpha, beta, preview, experimental, or early access. Such features may be incomplete, unstable, inaccurate, or subject to reduced support, and may be changed or removed at any time without notice. You agree that your use of the Service is not contingent on the future delivery of any feature, functionality, integration, or roadmap item unless expressly stated in a written agreement signed by TZ APAC.
Termination and Suspension
TZ APAC may, at its sole discretion, immediately suspend or terminate these Terms, any rights granted herein, or your access to or use of the Service, in whole or in part, at any time and for any reason, with or without notice. TZ APAC shall have the sole right to determine whether you have violated any provision of these Terms, and may restrict, throttle, suspend, or discontinue your access to the Service if your use may adversely affect the Service, other users, TZ APAC’s operations, or its ability to provide services.
You may terminate your use of the Service at any time by discontinuing use and, where applicable, by using the in-app deletion controls described in our Privacy Policy. On termination, all licences and rights granted to you under these Terms shall immediately cease, without affecting any accrued rights, obligations, or liabilities arising prior to termination. Because your records are held on your own device, termination neither deletes them nor gives us access to them.
Suspension Appeals: If your access is suspended or terminated and you believe this was done in error, you may contact us at [email protected] to request a review. We will consider such requests in good faith but are not obligated to reinstate access; any decision on reinstatement is at TZ APAC’s sole discretion.
Limitation of Liability & Warranty
No Warranty: You expressly understand and agree that your use of the Service is at your sole risk. The Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including, without limitation, implied warranties of merchantability, fitness for a particular purpose, non-infringement, quiet enjoyment, and any warranties arising out of course of dealing or usage of trade. To the maximum extent permitted by applicable law, we disclaim all warranties and representations that the Service, including any record or AI Output, will be accurate, uninterrupted, error-free, secure, or free of harmful components.
Nothing in these Terms excludes or limits our liability for fraud, fraudulent misrepresentation, wilful misconduct, death or personal injury caused by our negligence, or any other liability which cannot be excluded by applicable law.
Limitation of Liability: To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, or for any harm to a pet, arising out of or in connection with your use of, or inability to use, the Service, including without limitation any changes to, inaccessibility of, suspension or termination of the Service, inaccuracy of any record or AI Output, unauthorised access to or alteration of data, delay or failure of performance, or the acts or omissions of third parties, even if advised of the possibility of such damages.
TZ APAC’s total aggregate liability arising out of or relating to these Terms or the Service shall not exceed the greater of: (a) the total fees paid by you to TZ APAC in the twelve (12) months immediately preceding the event giving rise to the claim; or (b) SGD 100. This liability cap does not apply to: (i) liability arising from our fraud, wilful misconduct, or gross negligence; or (ii) any liability which cannot be limited by applicable law.
User Indemnity: You agree to indemnify, defend, and hold harmless TZ APAC and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to: your use of the Service; your violation of these Terms; your violation of applicable laws (including data protection laws and laws relating to Third-Party Individual Data); your infringement of any third-party rights (including intellectual property or privacy rights in content you upload); or any unlawful recording, sharing, or publication made using the Service, or any decision you make regarding a pet’s health or care in reliance on the Service. This indemnity obligation survives termination of these Terms.
Modifications to Terms and Force Majeure
Modifications to Terms: We may modify these Terms at any time. For material changes including changes to pricing, data processing practices, or dispute resolution we will provide at least 14 days’ advance notice by in-app notification and by posting the updated Terms on our website, and by email where you have provided one. Your continued use of the Service after the applicable notice period constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must cease using the Service before the changes take effect.
Force Majeure: TZ APAC shall not be liable for any delay or failure to perform resulting from causes beyond its reasonable control, including acts of God, natural disasters, epidemic or pandemic events, war, terrorism, civil unrest, governmental action or regulation, power failures, internet or telecommunications outages, cyberattacks, or failures of third-party infrastructure or service providers.
Governing Law & Jurisdiction
You and We agree that these Service Terms will be governed solely by the laws of the Republic of Singapore without regard to the conflict of law principles.
Any claim, dispute or controversy of whatever nature arising out of or relating to these Service Terms shall be referred to and finally resolved by arbitration in Singapore administered by the Singapore International Arbitration Centre (SIAC) in accordance with the Arbitration Rules of the Singapore International Arbitration Centre (SIAC Rules) for the time being in force, which rules are deemed to be incorporated by reference in this Section.
The seat of the arbitration shall be Singapore. The Tribunal shall consist of one (1) arbitrator. The language of the arbitration shall be English. This Section governs all claims arising out of or related to the Service Terms, including without limitation tort claims, unless otherwise provided in these Service Terms.
These Service Terms are personal to you and no third party is entitled to benefit under them. You agree that we can transfer our rights and obligations under these Service Terms to any other companies in the same group as us, or to any other company or firm or person provided that your rights under these Service Terms will not be adversely affected as a result of such transfer. You may not transfer your rights or obligations under these Service Terms to anyone else.
If any paragraph or section, or if any part of a paragraph or section, of these Service Terms is held to be unlawful, invalid or unenforceable by a court or legal authority, that paragraph or section, or any part of that paragraph or section, shall be treated as removed. The validity and enforceability of the remaining parts of these Service Terms shall continue and will not be affected.
To the extent we fail to or decide not to exercise any right of claim against you to which we are entitled, this will not constitute a waiver of that right unless otherwise indicated to you in writing.
